Uncursive End User License Agreement

This agreement is between you and László Zsolt Kustra ("we", "us"), the maker of the Uncursive app ("Uncursive" or "the app"). It covers the app, its updates, the reading models it downloads, and the Unlock you can buy inside it. You can read it on Uncursive's App Store page, from a link in the app's Settings, and at the address above. You accept it by installing or using Uncursive, and you confirm it when you buy the Unlock. If you don't accept it, don't use the app. If you are a minor, a parent or guardian must accept this agreement for you.

We wrote this agreement in plain language on purpose. Where a sentence has to be legal, it is still meant to be readable. Sections 10, 11, and 16 explain how it works with the consumer laws of the place you live.

1. Who you are dealing with

This agreement is between you and us only. Apple is not a party to it. We, not Apple, are solely responsible for Uncursive and for everything in it. Apple has no obligation to provide maintenance or support for Uncursive.

Apple and Apple's subsidiaries are third-party beneficiaries of this agreement. Once you accept it, Apple has the right, and is deemed to have accepted the right, to enforce it against you as a third-party beneficiary.

You downloaded Uncursive through Apple's App Store, so Apple's Media Services Terms and Conditions also apply to that transaction. Nothing in this agreement changes Apple's usage rules. Where Apple shows this agreement on the App Store, it takes the place of Apple's standard Licensed Application End User License Agreement.

2. Your license

Uncursive is licensed to you, not sold. We grant you a non-transferable license to install and use Uncursive on Apple-branded devices that you own or control, as permitted by the usage rules in Apple's Media Services Terms and Conditions. Other accounts associated with the purchaser may also access, acquire, and use Uncursive through Apple's Family Sharing, volume purchasing, or Legacy Contacts, under Apple's rules. The Unlock is shared through Family Sharing (section 3).

You may not:

• copy Uncursive except as this license and Apple's usage rules allow;
• distribute, rent, lend, sell, sublicense, or make Uncursive available over a network where several devices could use it at once;
• reverse-engineer, decompile, disassemble, or try to derive the source code of Uncursive, modify it, or make derivative works of it, except where the law expressly lets you do so despite this sentence (for example to achieve interoperability or to correct errors), or where an open-source component's own license lets you (see section 8);
• remove or alter any copyright, trademark, or other proprietary notice;
• use Uncursive to break any law, or to photograph and convert material you have no right to copy;
• use the cloud engine (section 5) to convert a page that shows sensitive details about another person, such as their health, beliefs, or politics; convert such pages with an on-device reading model;
• use the cloud engine (section 5) for anything that Apple's acceptable use requirements for the Foundation Models framework prohibit, or use the text it returns to train or improve another artificial-intelligence model.

We keep every right in Uncursive that this agreement does not expressly give you. Uncursive, its design, its name, and its icon are ours.

3. Free pages and the Unlock

Free pages. Uncursive is free to download and converts your first five pages at full quality with full export. A page counts as used when Uncursive takes it in for converting, before any text arrives. Converting that page again, retaking its photo, or converting it again after a failed attempt does not use another free page, because the page is already counted. Deleting a page does not give a free page back. The free pages are counted on each device separately. If you delete a page's text or reinstall Uncursive, converting that page again may count as a new page.

The Unlock. Uncursive offers one purchase, the Unlock. It is a single one-time in-app purchase, bought through Apple's App Store at the price the App Store shows you. It is not a subscription: it has no renewal and no expiry date. Once you own it, Uncursive converts as many pages as you like: Uncursive itself imposes no page limit, daily limit, credit, or meter of any kind. (The cloud engine, where Uncursive offers it, has a daily limit that Apple sets. That limit is Apple's, not ours, it may change, and it does not apply to the on-device models. See section 5.)

Nothing is ever taken back. A page you have already converted stays yours to read, edit, copy, and export, whether or not you own the Unlock, and whether or not you have free pages left.

Family Sharing. The Unlock supports Apple's Family Sharing, so members of the purchaser's family group can use it under Apple's Family Sharing rules.

Payment and refunds. Apple handles your payment, your receipt, and refunds, and the App Store shows you the price, including any VAT that applies, before you confirm. In the European Union you buy the Unlock from Apple Distribution International Ltd., the seller of record. Your right to cancel a purchase, and how to ask for a refund, are set out in Apple's Media Services Terms and Conditions and at reportaproblem.apple.com. If Apple refunds or revokes the Unlock, Uncursive returns to the free-page state, with the free pages you had already used still counted as used; your existing converted pages are not affected.

Restore. If you reinstall Uncursive or move to a new device, use Restore Purchases in the app to bring back the Unlock you own.

4. Your pages and your text

Everything you photograph, import, or type in Uncursive, and the text Uncursive reads from it, is yours. We claim no right to it. Uncursive gives us no access to it: the only way a page reaches us is if you send it to us yourself (section 5). We never use your pages or your text to train a model.

Uncursive stores each document as ordinary files on your device: a PDF of your pages and, once any page is converted, an editable text document. You can see them in the Files app, open them in other apps, and back them up as part of your normal device backup. Uncursive keeps no copy anywhere else. If you delete a document and it is not in your backup, it is gone; we cannot recover it, because we never had it.

One thing to know before you share a PDF from your Uncursive library: each page of the PDF carries, invisibly, that page's text as it stands in your text document, your corrections included, together with a few technical details about how the page was read. That hidden text is what makes the PDF searchable. Sharing the PDF therefore shares all of that as well as the page images. You are responsible for what you photograph and convert, and for having the right to do so.

5. How your pages are read

Uncursive reads your handwriting with a reading model that you choose. Nothing is converted until you have chosen one, and you can change your choice at any time in Settings.

On-device models. An on-device model reads your pages entirely on your device. Uncursive does not send the page anywhere. (A copy in your own iCloud backup or iCloud Drive is yours, handled by Apple under Apple's terms.) To use an on-device model, Uncursive must first download that model once. The download comes from Apple's servers, it is large, and it takes space on your device; Uncursive shows you the download size and asks you to confirm before a download starts. After the download, converting pages works without a network connection; buying or restoring the Unlock needs one. You can remove a downloaded model in Settings at any time and download it again later. Your mobile carrier or internet provider may charge you for data; we recommend Wi-Fi, and those charges are yours.

The cloud engine. Where Uncursive offers a reading model listed as "Private Cloud Compute", that is the cloud engine. If you choose it, Uncursive sends the image of each page you convert, in strips, to Apple's Private Cloud Compute service, which reads it and returns the text. The page leaves your device and goes to Apple. Uncursive says so where you make the choice, and the first time you pick this model on a device it asks for your consent to send the pages you convert, including what they say about your health, your beliefs or your politics. It tells you there that you cannot consent for anyone else, so pages that show other people's private matters belong on an on-device model. Apple states that Private Cloud Compute does not keep your page after it returns the text and that no one at Apple can access it; that is Apple's promise, made in Apple's terms and Apple's privacy policy, which govern what Apple does with the page. We never see the page or the text. The cloud engine is Apple's service: it works only where Apple Intelligence is available and turned on, it needs a network connection, Apple limits how many pages it reads for each person per day, and Apple may change, limit, or withdraw it. We do not control it and cannot promise that it is available; the on-device models do not depend on it. Apple's service may also decline to read a page or part of one, and it stops for the day when Apple's limit is reached. When that happens, Uncursive tells you and can read those parts with an on-device model you pick.

No account, no data collection. Uncursive has no account and no sign-in. It collects no data, has no analytics or tracking of its own, and sends nothing about you to us. Uncursive itself connects only to Apple's services: the App Store, Apple's asset delivery for model downloads, and, if you chose it, Private Cloud Compute. Links in the app open in your browser, the system's mail sheet, or the Settings app, which then connect on their own. If you have chosen at the system level to share diagnostics with app developers, Apple may give us aggregated analytics and crash reports under Apple's own terms; Uncursive puts nothing of your pages or your text into them. When you contact us. If you use Report Page on a page that failed, Uncursive prepares an email to us from your own mail account (or a share sheet, if Mail is not set up). It contains the image of that page, what failed, and technical details about your device, Uncursive, and the reading model you chose. You see all of it before you send it, and nothing is sent unless you send it. Check first that the page shows nothing you do not want us to see; a page can hold other people's details too. 6. Accuracy

Handwriting recognition is not perfect, and Uncursive will make mistakes. Where the reading model cannot commit to a word, it is meant to write the word "[unclear]", with its best guess after a colon when it has one, so that you can check the word against the page, which Uncursive shows in the same view as the text. It will not catch every doubtful word, and words it is sure about can still be wrong.

Always check converted text against the page before you rely on it. Where an unnoticed error could affect someone's health, legal position, money, safety, or employment, a person must check the converted text against the page before it is used; do not let Uncursive's output stand in for the page or make such a decision on its own. Keep your original pages if they matter.

How well Uncursive reads depends on the handwriting, the photo, the language, and the reading model you chose. Uncursive is built and tested for English handwriting; other languages may work with some reading models, but we do not promise any language. The free pages exist so that you can test Uncursive on your own handwriting before you pay.

7. Devices and requirements

Reading handwriting in Uncursive needs an iPhone or iPad that supports Apple Intelligence, running the version of iOS or iPadOS that Uncursive's App Store page names, or later. Uncursive is offered for iPhone and iPad only. The App Store may let you install Uncursive on other devices; on those, Uncursive tells you that it cannot run and offers nothing for sale. Some on-device models need more free memory than your device has at a given moment; Uncursive tells you when a model cannot run right now.

Uncursive saves each document as a standard PDF and a Word-compatible text document (.docx) that other apps can open, and it can also copy text and save it as plain text; the files carry no copy protection. The app and the Unlock are tied to the Apple Account that obtained them, through the App Store's own protection; there is no other technical protection measure. A problem that comes from your device or its operating system not meeting these requirements is not a defect in Uncursive. If you report a problem, please help us check, by the least intrusive means available, whether your device or its settings are the cause.

8. Third-party components and third-party terms

Uncursive includes open-source software, and its on-device reading models come from third parties. Those components belong to their authors and are licensed to you under their own terms, which govern them instead of section 2. When you use Uncursive you must comply with the third-party terms that apply to you, including Apple's terms for the App Store, Family Sharing, and Apple Intelligence, and the terms of your mobile or internet service.

9. Updates, support, and changes

Updates. We provide the updates, including security updates, that Uncursive needs to keep working as this agreement describes, for as long as you can reasonably expect for a one-time purchase. The App Store tells you when an update is available. If you choose not to install one, Uncursive may stop working with a newer version of iOS or iPadOS, and we are not responsible for a problem that comes only from the missing update. An update may add features. It may change or retire a reading model only for a good reason: Apple changes or stops offering a service the model depends on, a model's author withdraws or changes its license, a model no longer runs on supported devices, a security or legal need, or a better model replaces it. For as long as we provide updates, at least one on-device reading model stays available. No update takes away the Unlock you bought, the pages you converted, or the core function: converting your photographed handwriting to text on your device.

Support. We, not Apple, provide support for Uncursive. Write to us at the address in section 15. We answer as well and as quickly as we can. Ideas and suggestions you send us are welcome; we may use them freely and owe you nothing for them.

Changes to this agreement. We may change this agreement only for a good reason: a change in the law or in Apple's rules, a new feature, a new reading model, a security need, or to correct or clarify it. We publish the new version with its effective date at https://uncursive.com/eula and tell you about the change in the app or in the App Store notes of the update that brings it, before it applies to you. A change never reduces the rights you already have for the Unlock you bought, and it never takes away the pages you converted.

10. Warranty and your legal guarantee

What to expect. The free pages in section 3 let you test Uncursive on your own handwriting before you pay. Uncursive misreads some words and marks the words it is unsure of as "[unclear]"; that is how the product is meant to work. We do not promise error-free text, that Uncursive will never fail or be interrupted, or that it suits a particular purpose of yours.

Your legal guarantee. If the law of the country where you live gives you, as a consumer, a legal guarantee of conformity, as it does in the European Union, the United Kingdom, and Australia (in Hungary: kellékszavatosság), that guarantee applies in full and nothing in this agreement cuts it down. Your statutory rights against Apple Distribution International Ltd. as the seller of record in the European Union also stay unaffected. We give no commercial guarantee (in Hungary: jótállás) beyond your legal rights.

Apple's role. If Uncursive fails to conform to a warranty that applies to it, you may notify Apple, and Apple will refund the price you paid for Uncursive, including the Unlock. To the maximum extent the law allows, Apple has no other warranty obligation of any kind with respect to Uncursive. Any other claim, loss, liability, damage, cost, or expense attributable to a failure to conform to a warranty is our responsibility, not Apple's.

Everyone else, including consumers in the United States. UNCURSIVE IS PROVIDED "AS IS" AND "AS AVAILABLE". THE ENTIRE RISK AS TO ITS QUALITY AND PERFORMANCE IS WITH YOU, AND IF IT PROVES DEFECTIVE YOU BEAR THE COST OF ANY SERVICING OR CORRECTION, APART FROM THE APPLE REFUND ABOVE. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. SOME STATES AND COUNTRIES DO NOT ALLOW THIS; THERE, IT APPLIES ONLY AS FAR AS THE LAW ALLOWS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM PLACE TO PLACE.

11. Our liability

Always. Nothing in this agreement excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for harm caused intentionally or by gross negligence, or for any other liability that the law does not allow to be excluded or limited.

If you are a consumer in the European Union or the United Kingdom. We are liable to you as the law of the country where you live provides, and this section does not cut that down. Converted text is not a certified copy of your page: section 6 asks you to check the text before you rely on it, and if you do not, the law may reduce what we owe you in proportion to your own part in the damage (in Hungary: kárenyhítési kötelezettség).

Everyone else, including consumers in the United States. To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from or related to your use of or inability to use Uncursive, however caused and under any theory of liability, even if we were told such damages were possible; in particular, we are not liable for any loss that results from an error, an omission, or a word marked "[unclear]" in converted text. To the extent the law allows, our total liability to you for all claims related to Uncursive is limited to the greater of the amount you paid for the Unlock and fifty euros (EUR 50). Neither sentence limits a claim under a consumer-protection statute that does not allow it.

12. Claims, and who answers them

We, not Apple, are responsible for addressing any claim by you or by a third party relating to Uncursive or to your possession or use of it, including product liability claims, any claim that Uncursive fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws. Nothing in this section affects the statutory rights you have against Apple Distribution International Ltd. as the seller of record in the European Union.

If a third party claims that Uncursive, or your possession and use of it, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling, and discharging that claim.

13. Legal compliance

You represent and warrant that you are not located in a country or region that is subject to a United States Government embargo or that the United States Government has designated as a "terrorist supporting" country or region, and that you are not listed on any United States Government list of prohibited or restricted parties. You will not export or re-export Uncursive except as the laws of the United States and of the place where you obtained it allow.

14. Term and termination

This agreement lasts until you or we end it. You can end it at any time by deleting Uncursive from your devices. We can end it if you materially breach it, for example by distributing copies of Uncursive, and, where the breach can be put right, you have not put it right within thirty days of our written notice explaining it; your license ends in that case. If we decide to withdraw Uncursive from the App Store or to stop updating it, we announce that at https://uncursive.com/eula at least six months in advance; Uncursive and the reading models already on your device are not switched off. If a legal requirement, a court decision, or a decision of Apple's forces a faster end, or forces an update that disables Uncursive, we announce it as early as we lawfully can, and the promises in this section and in section 9 about updates and reading models yield to that requirement or decision. Ending this agreement does not affect the files Uncursive has already written to your device, which remain yours, and does not affect any right the law gives you. Sections 1, 4, 6, 8, 10, 11, 12, 13, 15, 16, and 17, the restrictions in section 2, and what section 3 says stays yours survive termination.

Complaints. Write to us by email or by post. We answer a written complaint in writing, with reasons, within thirty days. If we reject your complaint, we tell you which conciliation board or authority you can turn to. We have not made a general submission statement to the conciliation boards (általános alávetési nyilatkozat); section 16 says what that means.

16. Governing law and disputes

This agreement is governed by the laws of Hungary, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.

If you are a consumer in the European Union, the European Economic Area, the United Kingdom, or Switzerland, you also keep the protection of the rules of the law of the country where you usually live that cannot be set aside by agreement, and you may bring a claim against us either in the courts of that country or in the courts of Hungary; we may bring a claim against you only in the courts of the country where you live. If you are a consumer elsewhere, you keep any right your local law gives you to sue at home; this agreement gives you no further one. If you are not a consumer, the courts of Hungary have exclusive jurisdiction.

If you live in Hungary, you may also turn to a conciliation board (békéltető testület), a free out-of-court procedure run by the chambers of commerce, before going to court. The board for your place of residence is the competent one; you may choose another board instead. All boards, with their seat, telephone, website, and postal address, are listed at https://bekeltetes.hu. The board for Budapest, where our seat is, is the Budapest Conciliation Board (Budapesti Békéltető Testület), 1016 Budapest, Krisztina krt. 99. I. em. 111.; postal address 1253 Budapest, Pf. 10.; telephone +36 1 488 2131; email ; https://bekeltet.bkik.hu. The Budapest board is also the board designated for cross-border online disputes. We have not made a general submission statement; for a claim the size of the Unlock price, the law makes the board's decision binding on us anyway. The board's procedure is conducted in Hungarian; in cross-border online cases the Budapest board also communicates and decides in English.

17. General

If a court finds part of this agreement unenforceable, the rest stays in force. If we do not enforce a term, we are not giving it up.

Your license is personal to you and your Apple Account; you may not transfer this agreement to anyone else, except through Apple's Family Sharing as section 3 describes. We may transfer this agreement to someone who takes over Uncursive together with every obligation we have to you under it; we name them at https://uncursive.com/eula and in the app or the App Store notes, and your rights under this agreement do not change.

This agreement is written in English. If we publish a translation and the two differ, the reading that is better for you as a consumer applies, and where the law of your country requires the translation to govern, it does.
